EverSky Studio, LLC ("EverSky Studio", "we", "us" or "our") creates and publishes mobile games and related digital services. This Privacy Policy explains how we collect, use, share, and protect personal data when you interact with our games, websites, and any other online or offline services that link to this Privacy Policy (collectively, the "Services").

By downloading or playing our games, visiting our websites, or otherwise using the Services, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use the Services.

For the purposes of this Privacy Policy, "personal data" (or "personal information") means any information that identifies, relates to, describes, can be associated with, or could reasonably be linked to an identifiable person or household, as defined under applicable law.

1. Scope of This Policy

This Privacy Policy applies to:

  • Our mobile games and applications;
  • Our websites and web pages;
  • Our marketing, promotions, and communications; and
  • Customer support channels, surveys, and feedback forms that link to this Privacy Policy.

This Policy does not apply to third-party services that we do not control, such as app stores, social media platforms, or third-party websites you may access via links from our Services. Their privacy practices are governed by their own policies.

We may collect personal data directly from you, automatically from your device, and from third parties.

2.1 Information You Provide Directly

Depending on how you interact with our Services, you may provide the following personal data:

  • Contact details such as your name, email address, or other contact information.
  • Player identifiers such as your in-game username or profile name.
  • Customer support information, including messages you send us, bug reports, or other communications.
  • Content you share, such as in-game chat messages, feedback, or other materials you choose to submit.
  • Job application data if you apply for a role with EverSky Studio, such as your CV and related information.

Providing this information is voluntary, but certain features may not function without it.

2.2 Information Collected Automatically

When you use our Services, we and our partners may automatically collect certain information, including:

  • Device information such as device type and model, operating system and version, language and time zone, mobile network information, advertising identifiers (e.g., Apple IDFA, Google Advertising ID), and other device identifiers and settings.
  • Usage and analytics data such as game sessions (start and stop time, duration, frequency), in-game events (levels reached, items collected, achievements, progress), interactions with in-game features, and in-app purchase behavior (items purchased, value, currency; not full payment card details).
  • Approximate location data derived from your IP address or general region (for example, country or city-level location).

We typically collect this information through SDKs, APIs, cookies, and similar technologies integrated in our games and websites.

2.3 Information from Third Parties

We may receive personal data about you from:

  • App stores and platform providers (e.g., Apple App Store, Google Play) in connection with your downloads, purchases, or interactions with our games.
  • Social login and social media platforms (for example, if we allow login or game connection with Facebook, Sign in with Apple, or Google). This may include your name, profile picture, user ID on that platform, friend lists who also use our games, and other information you authorize.
  • Advertising and analytics partners, who may share segments or attributes (such as interests or inferred demographics) to help us understand our audience and show more relevant ads.

The data we receive from third parties is governed by their own privacy policies and your settings with them.

3. How We Use Personal Data

We use personal data for the following purposes:

  • Providing and operating the Services, including allowing you to download, install, access and play our games, saving your progress and game settings, and operating social or multiplayer features where available.
  • Improving and personalizing the player experience by analyzing gameplay and feature usage, customizing in-game offers, events, and rewards, and testing and developing new features and game modes.
  • Analytics and research, such as measuring engagement, retention, and monetization, and understanding trends and player behavior across our games and platforms.
  • Advertising and marketing, including showing our own games or offers in our Services or in third-party apps, allowing our advertising partners to show ads (including interest-based ads) within our games, and measuring and improving the effectiveness of our campaigns.
  • Customer support and communication, such as responding to your inquiries, bug reports, or feedback, and sending important service announcements, security alerts, or policy updates.
  • Safety, security, and fraud prevention, including detecting and preventing cheating, abuse, or other harmful behavior and protecting the integrity of our Services.
  • Legal and regulatory compliance, including complying with applicable laws and regulations, enforcing our Terms of Service, and establishing, exercising, or defending legal claims.

Where required by law (for example in the European Economic Area or the United Kingdom), we rely on one or more of the following legal bases: performance of a contract, legitimate interests, compliance with a legal obligation, and/or your consent (for example, for certain types of advertising or tracking).

4. How We Share Personal Data

We may share your personal data with the following categories of recipients:

4.1 Service Providers and Business Partners

We use trusted third parties to help us operate and improve our Services, such as hosting and backend infrastructure providers, analytics providers, customer support tools, marketing and advertising partners, and payment processing platforms. These partners process personal data only on our behalf and under appropriate contractual safeguards.

4.2 Advertising and Analytics Partners

With your consent where required by law, we allow third-party advertising networks and analytics providers to collect information about your use of the Services over time and across different applications and devices. They may use cookies, SDKs, and similar technologies to deliver and measure advertisements, build or refine profiles and segments, and provide reporting, attribution, and market research.

Before publishing our games, we will update this Privacy Policy to list the specific partners we integrate (for example, Google AdMob or Unity Ads) and link to their privacy policies.

If we are involved in a merger, acquisition, asset sale, financing, or similar transaction, your personal data may be transferred to the relevant third parties as part of that transaction, subject to appropriate confidentiality protections.

4.5 Other Users

If our games include social features (such as leaderboards, clans, or in-game chat), certain profile information—for example your username, avatar, game progress or high scores—may be visible to other players.

5. Cookies, SDKs, and Similar Technologies

On our websites and within our games, we and our partners may use cookies, software development kits (SDKs), and similar technologies to remember your preferences, analyze traffic and usage, personalize content, and provide advertisements.

You can manage cookie preferences via your browser settings and can limit certain forms of tracking via your device settings (see Section 7 below). If you disable cookies or limit identifiers, some features of the Services may not function correctly.

6. International Data Transfers

We are based in the United States, and we may process and store personal data in the United States and other countries. These locations may have data protection laws that differ from those in your jurisdiction and may not be considered to provide the same level of protection.

Where required by law, we use appropriate safeguards for cross-border transfers, such as standard contractual clauses approved by the European Commission, or other lawful transfer mechanisms.

By using the Services, you understand that your personal data may be transferred to, stored in, and processed in countries outside of your country of residence.

7. Your Rights and Choices

Depending on your location and applicable law, you may have certain rights regarding your personal data.

7.1 General Rights

Subject to legal limitations, you may have the right to access the personal data we hold about you, correct inaccurate or incomplete personal data, request deletion of your personal data (subject to legal retention obligations), restrict or object to certain processing activities, withdraw consent where processing is based on consent, and request data portability.

7.2 Advertising and Tracking Choices

On mobile devices, you can typically limit interest-based advertising or reset your advertising identifier in your device settings. For example:

  • iOS: Settings > Privacy & Security > Tracking and Apple Advertising (wording may change by version).
  • Android: Settings > Privacy > Ads (or similar, depending on device and version).

Third-party tools, such as "AppChoices" (where available), may also help you manage certain advertising preferences. These tools are operated by third parties, not by EverSky Studio.

Even if you opt out of interest-based advertising, you may still see ads, but they should be less tailored to your interests.

7.3 EEA/UK/Swiss Residents

If you are located in the European Economic Area, the United Kingdom, or Switzerland, you have the rights described above and the right to lodge a complaint with your local data protection authority if you believe our processing violates applicable law. We encourage you to contact us first so we can try to address your concerns.

7.4 California Residents

If you are a resident of California, you may have additional rights under the California Consumer Privacy Act (CCPA) and related laws, including the right to know what categories of personal information we collect, use, disclose, and (if applicable) "sell" or "share" as those terms are defined by law; the right to request deletion of personal information, subject to certain exceptions; the right to opt out of the sale or sharing of personal information for cross-context behavioral advertising; and the right to non-discrimination for exercising your privacy rights.

At this time, we do not sell personal information for money, but our use of certain advertising partners may be considered a "sale" or "sharing" under California law. You may contact us to exercise these rights or to request additional information.

8. Data Retention

We retain personal data for as long as reasonably necessary to provide and improve the Services, comply with our legal and regulatory obligations, resolve disputes, enforce our agreements, and protect our rights.

Retention periods may vary depending on the type of data and the purposes for which we use it. If you request deletion, we will also keep the minimum amount of information necessary to demonstrate that we have honored your request and to comply with applicable law.

9. Security

We use reasonable technical and organizational measures designed to protect personal data against accidental or unlawful destruction, loss, alteration, unauthorized disclosure, or access.

However, no method of transmission over the Internet or method of electronic storage is completely secure, and we cannot guarantee absolute security.

10. Children's Privacy

Our Services are not intended for children under the age of sixteen (16), and we do not knowingly collect personal data directly from children under 16 without appropriate consent as required by law.

If you are a parent or guardian and believe that your child has provided us with personal data without your consent, please contact us. We will review the situation and delete the data where required by law.

We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, or legal requirements. When we make material changes, we will update the "Last updated" date at the top of this page and may provide additional notice (such as an in-game notification or website banner) where required by law.
